ORDINANCE REGULATING THE APPROVAL OF TOWN ROADS FOR ATV/UTV USAGE ORDINANCE # J-52
SECTION I – TITLE AND PURPOSE
The purpose of this ordinance is to establish all-terrain vehicle and utility terrain routes in the Town of Jackson and to regulate the operation of ATV/UTV vehicles in the Town of Jackson.
SECTION Il – AUTHORITY
The Town Board of the Town of Jackson, Burnett County, Wisconsin has the specific authority to adopt this AllTerrain and Utility Terrain vehicle Ordinance under s. 23.33 (8) (b) and (11), Wis. Stats.
SECTION Ill – ADOPTION OF ORDIANCE
The Town Board of Jackson, Burnett County, Wisconsin, by this ordinance, adopted on proper notice with a quorum and unanimous vote by the town board provides the authority to designate all-terrain vehicle routes in the Town of Jackson and to regulate the use of those routes for ATV’s and UTV’s in the town.
SECTION IV – OPERATION OF ALL TERRAIN AND UTILITY TERRAIN VEHICLES
All Town of Jackson public roads are designated as ATV/UTV routes unless specifically signed as no ATV’s/UTV’s.
SECTION V – CONDITION APPLICABLE TO ALL-TERRAIN AND UTILITY TERRAIN ROUTES
All operators shall ride single file on the right side of the road.
All operators shall observe 25 MPH speed limit.
All operators shall slow the vehicle to IOMPH or less when operating within 150 feet of a dwelling or 100 feet of a pedestrian, cyclist. Or equestrian.
All persons born on or after January 1, 1988 must be certified in ATV safety education when operating an all-terrain or utility terrain vehicle per Wis Statute 23.33(5).
Children under 16 must be accompanied by an 18 or older adult.
All operators and passengers under age 18 are required to wear a helmet.
Owners of the ATV/UTV shall be responsible for the safe operation of their machine whether they are on them or not.
Routes must be signed in accordance with Statute 23.33 NR 64.12 and NR64.12(7) c.
A copy of this ordinance shall be sent by the town clerk to the Department of Natural Resources, the
Burnett County Sheriff’s Department and any other law enforcement agency serving the Town of Jackson.
Section VI-Enforcement
This ordinance may be enforced by any law enforcement officer authoriized to enforce the laws of the state of Wisconsin as stated in the Town’s citation authority addopted perms,66.0113.
Section VII-Penalties
The penalties under s. 23.33(13). Wis stats are adopted by reference.
Section VIII- Severability
If any provision of this ordinance or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without invalid provision or application and to end the provisions of this ordinance and severable.
Section IX EFFECTIVE DATE
This ordinance is effective on publiction or posting.
The town clerk shall properly publish this ordinance as required under s.60.80, Wis stats
